Late last week the BBC chose to delete from its website a damning Newsnight investigation into the Trafigura scandal, following legal threats from the company and its controversial lawyers, Carter-Ruck.

The mainstream UK media has so far assiduously avoided reporting on the BBC’s climbdown. Yet it’s an issue that raises serious questions about the state of press freedom in Britain, at a time of unprecedented attacks on the media.

Trafigura have a history of imposing gagging injunctions on news organisations in relation to their dumping in Abidjan.

Trafigura are aware of the toxic contents of the waste that was dumped on their behalf in Abidjan and of the possible effects on the local community since they themselves commissioned a report on it in 2006 through Waterson & Hicks, a UK law firm. This is the Minton report. Trafigura attempted to apply the gagging order to the reporting of a question raised in the House of Commons by Paul Farrelly MP. They now claim the matter cannot be raised there as it is sub judice.
